June 2024: Understanding MoCRA labeling requirements

MoCRA Label Requirements: The Modernization of Cosmetics Regulation Act (MoCRA) 2022 introduces significant changes to cosmetic labeling in the USA, aiming to enhance consumer safety and product transparency. Below are the key labeling requirements under MoCRA that cosmetic companies must adhere to:

Key Labeling Requirements

  1. Responsible Person Contact Information
    • By December 29, 2024, cosmetic product labels must include the contact information of the Responsible Person. This ensures consumers can reach out for inquiries or report adverse events.
  2. Fragrance Allergen Disclosure
    • MoCRA mandates the disclosure of fragrance allergens on product labels. The FDA will provide specific guidelines following public commentary, ensuring consumers are aware of potential allergens.
  3. Professional Use Products
    • Products intended for professional use must indicate compliance with FDA regulations starting December 29, 2023. This requirement ensures that professional-grade products meet safety standards.

Additional State Requirements

In addition to federal regulations, certain states, such as California, have specific ingredient reporting requirements. For instance, California’s Proposition 65 necessitates the disclosure of chemicals known to cause cancer or reproductive harm.

Compliance Deadlines

  • December 29, 2023: Professional-use product labeling.
  • December 29, 2024: Full compliance for all products.

These changes under MoCRA are designed to increase transparency and safety in the cosmetic industry. By adhering to these requirements, cosmetic companies not only comply with the law but also build consumer trust.
