SCCS preliminary opinion on Cannabidiol (CBD) used in cosmetic products.
On October 30th, 2025, the EU Scientific Committee on Consumer Safety (SCCS) adopted a preliminary opinion on the use of Cannabidiol in cosmetic products (SCCS/1685/25) establishing a maximum safe level for its use.
Scientific and Regulatory Background
Cannabidiol (CBD) is a naturally occurring cannabinoid found in Cannabis plants, although it can also be produced synthetically.
EU Member States and civil society organisations raised concerns about the limited safety information available for CBD in cosmetic products. In response, the European Commission mandated the SCCS to perform a safety assessment.
The impact of this preliminary opinion on CBD
Based on the submitted data, the SCCS has set maximum safe levels for CBD, and for delta-9-tetrahydrocannabinol (THC) when present as an impurity :
- CBD is considered safe up to 0.19% in dermal and oral cosmetic products
- THC impurities must not exceed 0.00025% (2.5 ppm) in dermal and oral cosmetic products
It is important to stress that this opinion does not cover products that may lead to inhalation exposure, so these safe levels do not apply to sprayable or aerosol formats, powders, pressurised sprays or any form that could generate inhalable particles. This mean that these products would be excluded from the regulation transposition and CBD would be forbidden in these products.
What is next?
The preliminary opinion is open for comments until January 21st, 2026. During this period, stakeholders may submit clarifications on the assessment, but no new data can be introduced. After the consultation closes, the SCCS will review the input, finalize its assessment and release the final opinion.
Under Article 31 of the Cosmetic Regulation, the European Commission may then amend the relevant Annexes if a potential health risk is identified or to reflect scientific and technical progress.
